Illinois Allows Lawsuits Against Gun Industry for Marketing to Minors and Improper Advertising Practices

Illinois Governor J.B. Pritzker has signed a bill that allows firearm retailers and manufacturers to be sued for marketing guns to individuals under 18 and engaging in improper advertising practices. The bill comes in the wake of the state Supreme Court upholding Illinois' ban on certain high-powered guns and high-capacity ammunition magazines. The new law, known as the Firearms Industry Responsibility Act, also allows civil action against firearms businesses if they are found to have marketed guns for unlawful paramilitary or private militia-related activities. The measure passed in the legislature with a vote of 71-40 in the House and 34-22 in the Senate.

Governor Pritzker, speaking at a conference for the gun control group Everytown for Gun Safety, stated that gun manufacturers should not be able to hide from the law. Critics of the bill, including gun rights advocate Todd Vandermyde, argue that it could infringe on the rights of gun dealers and may be challenged in the courts. However, Pritzker and other supporters of the measure maintain that it is necessary to hold firearms businesses accountable and to create a safer Illinois.
